Terms and Conditions – Tokyo Bike Bliss
In joining our bike tour service, named Tokyo Bike Bliss, run by Kay Cycling, you are deemed to have read and agreed to the following terms and conditions:
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Participant(s)”, “You” and “Your” refers to you and your party, people joining our bike tour service, Tokyo Bike Bliss, and accepting the terms and conditions. “Ourselves”, “We” and “Us”, refers to our service.
1. Booking and Payment:
1.1 All tour bookings are subject to availability. Due to the simultaneous acceptance of multiple bookings, we reserve the right to adjust the reserved date and time based on availability. In such cases, we will make reasonable efforts to accommodate the participant’s preferences and will communicate any changes promptly.
1.2 Full payment is required at the time of booking to secure a slot on the tour.
1.3 Payments can be made via PayPal.
1.4 By making a payment, the participant acknowledges and agrees to abide by the terms and conditions outlined herein.
1.5 Until payment is received, the reservation is not considered confirmed. A confirmation email or other means of communication, including the issuance of an invoice, will be provided.
1.6 The participant is required to make the payment within 48 hours of receiving the invoice. Failure to do so may result in the automatic cancellation of the provisional reservation without prior notice.
1.7 Changes such as the starting time, duration, or route of the tour are subject to additional charges. The amount of these charges will be determined based on the specific changes requested and the as-is price list.
1.7.1 Changes described in Section 1.7 must be declared and approved by us before the payment is processed. This ensures a smooth transaction and allows us to accurately adjust the cost based on your request.
1.8 If the tour start location requested by the participants is outside the area we cover, we will either charge additionally by changing the route as described in 1.7 or cancel the reservation. The decision will be made by us.
1.8.1 Cancellations made for 1.8 are eligible for a full refund.
2. Cancellation and Refund:
2.1 Cancellation requests must be submitted via email or any other means we requested.
2.2 Cancellations made 1 day prior to the tour start date are eligible for a full refund.
2.3 No refunds will be provided for cancellations made on the day of the tour start date.
2.3.1 In the event of a No Show or a delay exceeding 30 minutes from the scheduled start time of the tour, the reservation will be automatically canceled, and no refund will be issued.
2.3.2 Refunds will not be issued to the participant(s) who have been denied participation in the tour due to reasons outlined in section 3 both before and during the tour.
3. Tour Participation:
3.1 Participants must be in mentally and physically good health and capable of participating in the tour.
3.2 Participants are required to follow the instructions of the tour guide for their safety.
3.3 We reserve the right to refuse participation to those meeting any of the following criteria:
3.3.1 Those who have consumed alcohol prior to the tour and are deemed to be intoxicated.
3.3.2 Those who consume alcohol during the tour.
3.3.3 Those who use electronic cigarettes or smoke in non-designated areas during the tour.
3.3.4 Those who use a smartphone or other electronic devices while cycling. However, using them is permitted when the bicycle is stationary and safely parked.
3.3.5 Those aged 12 and below or those below 145cm or above 185cm in height.
3.3.6 Those who are over 100kg in weight including their belongings.
3.3.7 Those wearing clothing considered unsuitable for cycling, such as skirts, sandals, flip-hops, etc.
3.3.8 Those who are unable to ride a bicycle comfortably and safely.
3.4 Participants consent to us using photos and videos of you taken during the tour for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes such as brochures, websites, and social media.
3.4.1 Participants reserve the right to disagree to 3.4, in which case, participants must declare before the tour begins.
3.5 When we make the cancellation described in 3.1, 3.2, and 3.3, participants will NOT be eligible for any refund
4. Liability:
4.1 Participants acknowledge the inherent risks associated with cycling tours and that they are responsible for assessing their own ability to ride a bicycle safely and comfortably.
4.2 We are not liable for any injury, loss, or damage to personal property during the tour.
4.3 Participants understand and accept that they are responsible for their own actions during the tour.
4.4 We are not liable for any accidents, injuries, or damages caused to participants or any third party in connection with the tour, except for liability covered by the casualty insurance.
4.5 Participants agree not to hold us or any other participants responsible for any incidents described in 4.4 and not to make any claims or calls for responsibility against them.
4.6 Participants are advised to follow safety guidelines and instructions provided by the tour guide, and any failure to do so may result in increased personal risk.
4.7 We are not liable for any medical expenses incurred by participants during or after the tour.
5. Tour Changes and Cancellations:
5.1 We reserve the right to change or cancel a tour due to adverse weather conditions or unforeseen circumstances.
5.1.1 When we make the cancellation described in 5.1, participants will be eligible for a full refund if the cancellation is not attributed to any fault on their part.
5.2 In the event of a cancellation by us, participants will be offered an alternative tour date or a full refund.
5.3 We reserve the right to alter the tour route or itinerary during the tour based on road conditions, safety concerns, or other unforeseen factors.
5.3.1 Any such alterations will be made with the primary focus on participant safety and the overall quality of the tour experience.
5.3.2 Participants acknowledge that changes to the tour route or itinerary due to road conditions or other unforeseen factors do not entitle them to a refund or compensation.
5.4 We reserve the right to cancel the tour during the tour itself due to adverse weather conditions or unforeseen circumstances.
5.4.1 In the event of a tour cancellation during the tour, participants will be eligible for a 100% refund if the cancellation is not attributed to any fault on their part.
5.5 The standard duration of the tour is supposed to be 3 hours, unless otherwise specifically mentioned, but the actual end time may vary by approximately 10 minutes due to traffic conditions.
5.5.1 Participants are advised to account for this potential variation in the end time when making post-tour arrangements.
5.5.2 If participants wish to extend the duration of the tour, additional charges may apply, and such requests will be accommodated based on availability.
6. Equipment Rental:
6.1 Rental equipment, including helmets and bicycles, must be returned in the same condition it was received.
6.2 Participants are responsible for any damage or loss of rental equipment and will be charged accordingly.
7. Privacy Policy:
7.1 Personal information provided by participants will be treated in accordance with our privacy policy.
8. Governing Law:
8.1 Participants hereto submit to the exclusive jurisdiction of the Tokyo District Court of Japan in respect to all controversies arising from or in relation to this Agreement, its performance, or any breach thereof.
9. Changes to Terms and Conditions:
9.1 The content of these Terms and Conditions may be changed without any prior notice.
9.2 Changes will take effect immediately if the updated Terms and Conditions are based on the February 1st, 2024 date.
9.3 In the event of any changes, participants will be notified through the publication of the amended terms on the website.
9.4 By continuing to use the services after changes have been made, participants are deemed to have agreed to the modified terms.
